Last week, we advised that the Texas Secretary of State’s new business filing platform, SOSPortal, was expected to launch on September 28. The Secretary of State has since announced a revised implementation schedule. According to the State’s latest update, SOSPortal is now scheduled to launch on Tuesday, September 29, 2026.
As a result, the dates and deadlines associated with the transition have changed.
Revised System Availability
The Texas Secretary of State has announced that online corporate filing services, searches, and orders will be unavailable from September 25 at 12p CT until September 29 at 8a CT. SOSDirect and SOSUpload services will not be accessible and will be replaced by SOSPortal when it launches.
Updated Filing Deadlines
To accommodate the Secretary of State’s revised implementation schedule, Capitol Services will observe the following cut-off times for business filings submitted during the transition period:
- Next-Day Filings: Requests for next-day processing must be received by 10:30a CT on September 24 to accommodate the Secretary of State’s noon cut-off time and will be processed by the end of the day on September 25.
- Same-Day Filings: Requests for same-day processing must be received by 10:30a CT on September 25 to accommodate the Secretary of State’s noon cut-off time and will be processed by the end of the day on September 25.
- Standard Expedited and Routine Filings: Filings must be received by 3p CT on September 25 and September 28 to accommodate the Secretary of State’s 5p cut-off time, but they will not be processed until the new system is implemented.
Planning Ahead
If you have Texas filings with time-sensitive deadlines, we encourage you to review upcoming projects as soon as possible and submit requests early where practical. Texas continues to allow filings to be submitted with a delayed effective date or delayed effective condition, which may provide additional flexibility during the transition period.
