Recent Kansas bankruptcy court decisions regarding the effectiveness of
financing statements against individual debtors have indicated that the debtor
name “Mike” is a reasonable variation of the given name “Michael,” and that a
financing statement under the name “Mike Erwin” is equally effective as a
financing statement under the name “Michael Erwin.”
If courts continue to utilize this logic, it may be necessary for a UCC searcher to
request multiple searches under reasonable variations of an individual’s name in
order to discover all financing statements that may be judged to be effective. There
is no individual name registry or standard rule for determining the correct
name of an individual for UCC filing or searching purposes.
